Terms & Conditions
A. As the Artist:
I reserve all rights and ownership to the commissioned artwork.
I reserve the right to post the commissioned artwork, in its finished form and/or WIP form, in my designated platforms for the purposes of self-promotion and commission samples. The post will indicate that it is a commissioned artwork and include the client’s handle/name. The client may request for adjustments regarding this rule (e.g. requesting for the commissioned artwork not to be posted or for the client’s name not to be included in the post). In order for the request to push through, there must be an agreement between the client and artist. Such requests may only be done during the stage of Commission Details Discussion.
I reserve the right to refuse a commission for any reason without disclosure.
I reserve the right to repurpose any element/s used in a canceled/refunded commission artwork.
I reserve the right to add my watermark on the commissioned artwork.
I reserve the right to change my Terms and Conditions; but changes will be mentioned in the Site Updates section of this page.
B. As the Client:
You're required to read the full Terms & Conditions prior to pushing through with the commission. Proceeding with the commission indicates that you have read with full understanding and agree with the stated terms and conditions.
You're to use the commissioned artwork for personal use only - not for profit. Examples of personal use include, but are not limited to, using it as a device wallpaper, digital profile picture and/or banner, or room décor. Usage of the commissioned artwork requires proper credits to the artist and a link back to at least one of the artist’s platforms. For commercial commissions, please see Section L.
You're allowed to post the artwork on your personal digital platforms under certain conditions. First, the post must include visible and proper credits to the artist and a link back to at least one of the artist’s platforms; second, the contents of the post must not be related to anything that may be deemed offensive or illegal in any way, shape, or form; and third, the post draft must be viewed and approved by the artist prior to its posting. The artist serves the right to decline giving permission without disclosing the reason.
You’re to retain your rights to your own character/s and/or design.
You're not allowed to alter/edit the commissioned artwork. This includes, but are not limited to, removal of the watermark, editing of certain elements, and recoloring. However, if there are certain changes you wish to be made, even if the commission has already been completed, feel free to discuss this with the artist.
You're not allowed to claim the commissioned artwork, or any of the artist's artwork, as your own.
You're not allowed to trace over the commissioned artwork.
You're not allowed to utilize the commissioned artwork for anything related to Non-Fungible Tokens (NFTs).
You're not allowed to use the commissioned artwork to train Artificial Intelligence (AI).
C. Subjects/Themes of the Commission
1. Themes/subjects that I'm willing to do:

Fanart
Furry/anthro (may depend on the kind, feel free to discuss it with me)
Humans
Animals/creatures (may depend on the kind, feel free to discuss it with me)
Mild gore (blood stains and such alike)
2. Themes/subjects that I'm not willing to do:
Anything that is considered offensive (may they be themes or figures)
Heavy gore
Nsfw
Mecha
Armor
Fetish Art
Heavily detailed backgrounds
Anything NFT related
Clarification on NSFW: The artist may not be willing to draw NSFW, but they do allow the commissioned artwork to be used in NSFW settings.
D. Stages of the Commission
1. Commission Details Discussion
This stage is where the details of the commission, its estimated price, and additional requests are discussed.2. Transaction
This stage is where both the artist and client reach an agreement on the details of the artwork to be commissioned and where payment shall be accomplished.3. Sketch
In this stage, the artist will present the client a sketch of the artwork.4. Draft of the Artwork
In this stage, the artist will present the client the artwork in its cleaned-up, colored, and minimally rendered form.5. Final Touches
In this stage, the artist will present the client the semi-finished artwork for any finishing touches.6. Finished Artwork
The client will be handed the finished artwork.
E. Ordering the Commission
Proceeding with a commission indicates that you have read, understood, and agree with the terms & conditions.
A slot will only be secured once payment has been received and acknowledged by the artist.
It is required for the client to provide details of the contents of their commission. This is to ensure accuracy of the commissioned artwork. References, detailed photos, rough sketches/doodles are much preferred and appreciated. Design requests (details outside the provided details by the client) involve additional fees that depend on its complexity.
The artist may charge additional fees if they deem the commission to be highly complex. This will be discussed to the client during the Commission Details Discussion stage.
Once the client and artist have agreed on the price and details of the commission, there will no longer be any additional fees added by the artist. However, requests made by the client post-agreement are subject to additional charges.
The client must wait for the artist’s acknowledgment before sending payment.
Commissions below 100$/5000 Php must be paid in full. Those that are priced more than such are eligible for 60% down payment; the remaining 40% is to be paid when the commissioned artwork is finished.
Payment transactions will be done through Paypal (international) or Gcash (PH local).
F. Revisions
The client is entitled to 3 minor revisions and 1 major revision for free within the Sketch stage; 2 minor revisions for free within the Draft of the Artwork stage; and 1 minor revision for free within the Final Touches stage.
Major revisions are no longer allowed once the sketch has been approved by the client.
If the stage in which the free revision/s is/are limited to have come to pass, the respective unused free revision/s will be considered forfeited.
Succeeding revisions are subject to additional charges - 10% of the agreed commission price for major revisions; and 6% of the agreed commission price for minor revisions.
G. Defining Minor and Major Revisions
1. Minor Revision
Pertains to changes that involve, but are not limited to, redrawing of small elements (limited to Sketch stage), color correction, and/or lighting/shading correction.2. Major Revision
Pertains to changes that involve, but are not limited to, pose changes and/or redrawing of large elements.
H. Timeframe
The commission may take a minimum of 1 week to 6 months max to complete. The timer starts once the artist has received and acknowledged payment. However, if the commission is deemed complex by the artist, a longer timeframe will be given.
The timer is set to a pause when the commissioned artwork is up for the client's approval. This will be done before moving on to the next stage (applicable to stages post Transaction till Finished Artwork). If 5 days have passed and the client has yet to respond with feedback, it will automatically be considered approved and the artist will proceed to the next stage.
Once the commissioned artwork is done, the artist will only be keeping the raw file of the commissioned artwork for 1 month max.
I. Cancellation & Refund
The client may only cancel once the sketch is revealed. If the client decides to push through with the cancellation, the artist will be refunding the client 70% of the agreed price. Once the client has approved of the sketch, cancellation will no longer be an option.
If the artist no longer wishes to work with the client, the artist will be issuing a 100% refund to the client - may there already be progress on the commission or not.
The artist will issue a full refund to the client if the agreed deadline has come to pass and the commissioned artwork has yet to be finished.
The client is not authorized to issue a chargeback for any reason. Contact the artist to discuss refund and cancellation.
J. The Final Product
The client will be recieving their commissioned artwork in .png or .jpeg at 300 DPI resolution.Keep in mind that the commissioned artwork may slightly differ from the artist's artwork samples. This is due to multiple factors, such as development of art skills.
K. General Etiquette
Harassment in any form for any reason will not be tolerated.
Any personal information learned during the transaction must not be shared anywhere else.
L. Commercial Use
A commission artwork is considered commercial if it will be used to generate profit. These commission artworks are typically reproduced for sale and/or serve as material in the creation of another product. Examples of commercial commission artworks include, but are not limited to, brand logos, mascots, prints, stream/video elements, and emotes.
The price for a commercial commission artwork is 300% of the base commission price. For example, if the base price is $5, the commercial price will be $15. Commercial commission artwork shall be paid in full upfront.
Depending on the intended commercial use of the commissioned artwork, the watermark may be removed. Please discuss this with the artist.
